(02/08) Survey reports for assisted living facilities in Iowa remain sealed from public view for a year and more

In 2002, The Des Moines Register disclosed that the state kept two sets of inspection reports on assisted living facilities and released only the sanitized versions to the public.  The Governor fired the Department of Elder Affairs’ director of assisted living and transferred regulatory authority to the Department of Inspections and Appeals.   Legislation enacted in Iowa in 2005 included a provision, insisted on by the assisted living industry, that blocked access to reports “until the conclusion of all administrative appeals.”  Clark Kauffman, “Lawmakers: Revisit shroud on assisted-living reports,” The Des Moines Register (Feb. 18, 2008).  The Des Moines Register has now reported that survey reports have remained sealed for a year or more.  One of the bill’s sponsors, surprised that reports were sealed for more than 30-45 days, agreed that the legislation might need to be reconsidered.
