(03/08) Washington State enacts legislation requiring assisted living facilities to retain Medicaid residents when they voluntarily terminate their Medicaid contract

Assisted living facilities that voluntarily terminate their Medicaid participation must allow Medicaid residents to remain if they were receiving Medicaid on the day before the effective date of the termination or if they had paid privately for at least two years and became eligible for Medicaid within 180 days of their facility’s termination.  The Washington State legislation, HSB6807, was signed by the Governor on March 28, 2008.  She vetoed section 2, which required facilities to disclose their Medicaid policy in writing.  The Aging and Disability Services Administration advised assisted living facilities that the bill went into effect immediately.  ADSA,  “Dear Administrator” Letter, BH #2008-006 (April 21, 2008).
