What is it called?
· Assisted Living Facility / Residential Health Care Facility
What services are provided?
· Facility provides or coordinates in a negotiated service agreement:
o Assistance with activities of daily living including but not limited to: meals, housekeeping, transportation, planned activities
o Intermittent skilled nursing services
o Regular skilled nursing services if the services are limited in scope
o Medication administration
o Service agreement may contain hospice or family support services
Who can be admitted?
· Need for assistance with activities of daily living
· Specific needs determined by functional capacity screening conducted on or before admission
Who is inappropriate?
· Must be refused admission or evicted
o Needs cannot be provided by the facility
o Pose a danger to others
o Require physical restraints
o Incontinence where resident cannot or will not assist in management of problem
o Immobile requiring total assistance to exit the building
o On-going need for two-person transfer
o Require continuous 24-hour skilled nursing intervention
o Unmanageable behavior
· Exceptions to disqualifying conditions
o Residents who have the following conditions may be accommodated only if the negotiated service agreement includes necessary hospice or family support or similar services available 24-hours a day
§ Incontinence where resident cannot or will not assist in management of problem
§ Immobile requiring total assistance to exit the building
§ On-going need for two-person transfer
§ Require continuous 24-hour skilled nursing intervention
§ Unmanageable behavior
What training is required for direct care staff?
· Training for unlicensed staff who do not administer medication and have not completed a state approved training course
o 40 hours of training, supervised by RPN in basic resident care skills, including:
§ Emergency prevention and procedures
§ Infection control
§ Prevention of abuse, neglect, or exploitation of residents
o Completion of an approved resident care and treatment course and examination after 90 days of employment
· Training for a certified medication aide (qualified to administer medication)
o State-approved 75-hour course in medication administration that includes a minimum of 25 hours of clinical instruction
o Pass a state test
o Complete a 10-hour continuing education program every two years
Is nurse staffing required?
· A licensed nurse must be available on-site or by telephone to provide immediate direction to medication aides and nurse aides to meet residents’ unscheduled needs
Is there any oversight of these facilities?
· All adult care homes (including assisted living facilities) are required to be licensed by the Secretary of the Kansas Department on Aging (KDOA)
· Rules and regulations have been adopted by the KDOA to ensure safe, proper and adequate treatment and care
· Inspections and investigations are conducted as necessary
Is any public payment available?
· Yes, the Medicaid program may pay for assisted living services through a Medicaid Home and Community Based Services Waiver
